Terms of Service

These Terms apply to this website and to permanent makeup services provided by Svetlana Popova. By using the website, booking an appointment, or receiving a service, you agree to these Terms and to the policies referred to in them. If you do not agree, please do not use the website or book an appointment.

Section 1

Who these Terms are with

This website and the services described on it are operated by Svetlana Popova, an individual permanent makeup artist working as a sole proprietor in Rochester, New York. In these Terms, "we", "us" and "the studio" mean Svetlana Popova, and "you" means the client or website visitor.

Section 2

Eligibility

You must be at least 18 years old to receive permanent makeup services. Permanent makeup is a form of tattooing under New York law, and it is not performed on minors under any circumstances, with or without a parent’s consent.

By booking an appointment, you confirm that you are at least 18 and legally able to enter into these Terms.

Section 3

Booking, deposits, and cancellation

Appointments are subject to the Booking, Cancellation & Refund Policy, which forms part of these Terms. It sets out the deposit, the notice required to cancel or reschedule, and what happens after a late cancellation or a missed appointment.

Deposits and payments are taken through Square, whose own terms apply to the payment transaction itself.

We may decline or cancel a booking where the procedure would be unsafe, where the required health information has not been provided, or where a client's conduct makes the appointment impossible to perform.

Section 4

The service and professional judgment

Permanent makeup is a skilled cosmetic procedure performed on living skin, and it is applied using the artist's professional and aesthetic judgment. By booking, you acknowledge that:

  • the result depends on your skin type and condition, the treatment area, your healing, and your aftercare
  • the healed colour, pigment retention, density, duration, and exact final appearance cannot be guaranteed
  • a healed result is not a copy of a reference image, and normal variation from a reference or a preliminary drawing is not a defect
  • the shape and shade are agreed with you before pigment is applied, and the artist may decline a request that would be unsafe or that she cannot perform to a professional standard

The result is assessed only after the healing period described in the Booking Policy has passed.

Section 5

Your responsibilities

You agree to:

  • give accurate and complete personal and health information, and to tell us about any condition, medication, allergy, pregnancy, or previous permanent makeup that may affect your eligibility or your healing
  • follow the preparation instructions before the appointment and the aftercare instructions after it
  • arrive at the scheduled time, and give the required notice if you cannot
  • tell us promptly if you have a concern about healing

We are not responsible for complications caused by health information that was not disclosed to us, or by aftercare instructions that were not followed.

Section 6

Prices and payment

Prices are quoted before the appointment and may change over time; the price that applies is the one confirmed at booking. Payment for the service is due at the appointment unless agreed otherwise, and the deposit is applied to it.

Once a permanent makeup procedure has been fully performed, payment for the completed service is not refundable — including where you later change your mind or your aesthetic preference. Deposits are treated as set out in the Booking, Cancellation & Refund Policy.

Nothing in this section limits any right or remedy that cannot lawfully be waived under federal, New York State, or local law, and nothing in it applies to an appointment the studio itself cancels and cannot reschedule — that situation is covered by Section 10 of the Booking Policy.

Section 7

Using this website

You may not use this website or its content to break the law, to infringe intellectual property rights, to send malicious code or interfere with the site's operation, or to harass, impersonate, or misrepresent your identity. We may restrict access where this happens.

The text, photographs, and design on this website belong to the studio or are used with permission, and may not be copied for commercial use without written permission.

Section 8

Reviews, photographs, and what you send us

You keep ownership of what you send us and of any review you write. Nothing in these Terms requires you to write a positive review, and nothing here restricts what you may honestly say about your experience.

We may quote or link to a review you have already published publicly. Your name, your likeness, and photographs of you are used in advertising or on social media only with your separate written permission, which you may decline without affecting the service you receive.

You are responsible for the content you send us, and you confirm that you have the right to send it — including any reference image belonging to someone else.

Section 10

Personal information

How we handle your personal information is described in the Privacy Policy, which forms part of these Terms.

Section 11

No warranty

The website is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, or that the information on it applies to your individual case. The information pages on this website — including those about the procedure, preparation, aftercare, and risks — are general information and do not replace advice from a doctor.

Section 12

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for dissatisfaction with an aesthetic result that was properly performed, or for healing problems caused by undisclosed health conditions or by aftercare instructions that were not followed.

Where liability cannot be excluded, it is limited to the amount you paid for the particular service concerned.

This section does not exclude liability for personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

Section 13

Indemnification

You agree to indemnify and hold harmless Svetlana Popova against claims, losses, and reasonable legal costs arising from your breach of these Terms, from information you gave us that was false or incomplete, or from your failure to follow the aftercare instructions.

Section 14

Termination

We may stop providing the website or decline further service if these Terms are breached. Obligations that arose before that point — including payment for services already performed — remain in effect.

Section 15

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions stay in full force.

Section 16

Entire agreement

These Terms, together with the Booking, Cancellation & Refund Policy and the Privacy Policy, are the entire agreement between you and the studio about the use of this website and the booking of services, and replace any earlier understanding. They do not replace the informed-consent documentation you sign in the studio before a procedure.

Section 17

Governing law

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Disputes are subject to the courts located in Monroe County, New York, unless the law gives you the right to bring a claim elsewhere.

Section 18

Changes to these Terms

We may update these Terms. The updated version takes effect when it is posted on this page, and the date below shows when it was last changed. Continuing to use the website or booking an appointment after that means you accept the change. The Terms that apply to an appointment already booked are the ones in effect when you booked it.
